1. SOLE AGENCY

Link Agency will be sole agents from the date of this agreement until terminated by either party giving 28 days written notice, but subject to a minimum period of 12 weeks. The fee referred to in Clause 3, in addition to any other costs or charges agreed will become due, if at any time unconditional contracts of the sale of the property are exchanged with a Buyer introduced by us during the period of sole agency or with whom we had negotiations about the property during that period; or with a Buyer introduced by another agent during that period.

2. SALE BOARDS

Link Agency will erect a ‘For Sale’ board at the property. Regulations permit the display of one only ‘For Sale’ board. You agree not to allow the display of any other ‘For Sale’ board whilst Link Agency board is displayed.

3. FEES

Link Agency will charge a fixed fee at £595. This fee is subject to VAT. The fee includes all promotional costs other than special expenditure specifically agreed in writing. Link Agency reserve the right to make an administration charge of £75 plus VAT payable upon the termination of this agreement, payable within 14 days. Should this remain unpaid after a 14 day period the charge will increase to £150 + VAT. Link Agency reserve the right to retain discounts on charges offered by third parties.

Additionally Link Agency will charge a fee of 1.25% + VAT on the surplus of any sale price which is achieved over £100,000 on the property.

In circumstances where it is necessary for Link Agency to conduct accompanied viewings there will be a fee payable of £250 + VAT for this service, irrespective of the number of viewings undertaken. This will be invoiced once the client has signed these terms and is payable within 14 days.

4. PAYMENT OF FEES

Fees are due for payment on exchange of contacts.

5. SERVICES TO BUYERS

In addition at estate agency services, Link Agency may directly or through any connected person or company offer to arrange financial services products for Buyers and be entitled to retain commission or earnings in respect of any such services arranged. Link Agency will confirm in writing to you promptly all offers from prospective Buyers. Link Agency will send you, in writing details of any such services provided to any prospective Buyer.

6. UNOCCUPIED PROPERTY

Link Agency cannot accept responsibility for the maintenance or repair of unoccupied property for sale unless also appointed to manage the property.

7. MARKETING OF PROPERTY

The property will be marketed at an asking price of £ .This asking price does not represent a valuation, it is as recommended asking price based on our knowledge of previous sales and the prevailing level of asking prices in the area. The sale price achieved will depend on the number of potential buyers in the market place, the level of similar properties available during the marketing process and general market conditions. Other factors such as the speed of sale required, the buyer’s survey or the lender’s valuation may also affect the eventual sale price. Details of the property contents included in the sale will be included in the property particulars. Property particulars will be promoted on the Link Agency website affiliated to the Link Agency website. Marketing will commence from ( )

8. ESTATE AGENTS ACT 1979

This Act requires Estate Agents and any connected person to inform Buyers of any interest they may have in the property to be marketed. To assist in the process we ask sellers to inform us of any interest that they or their relatives (by blood or marriage) have in Link Agency or any of its subsidiary companies.

We have an established complaint procedure, copies of which are available upon request.
